The Mold Issue

The Association has a legal interpretation of the Governing Documents with regard to Internal Unit Mold. See below.

The Association is NOT liable to remediate INTERNAL MOLD other than if the internal mold can be proven to be a result of EXTERNAL COMMON AREA FAULT

If mold is reported; the Association will arrange an inspection to determine the cause.

If the cause is determined to be EXTERNAL FAULT the Association will remediate up to and including any affected internal dry wall only.

If the cause is determined to be OTHER than EXTERNAL FAULT it is the responsibility of the Homeowner and should be remediated under individual Homeowner Insurance.

Homeowners are free to engage an inspection company of their choice at their own expense.

If the results differ from the Association Inspection; the Homeowners independent inspection results will be forwarded to the Association Inspectors for their evaluation and comment.
